Terms of Sales

The clauses stipulated below are brought to the attention of the customers by the company MYAZ PIECESAUTO. Any person or entity who has a repair order established in his name or corporate name is deemed to be a client. In the event of a dispute regarding the execution of these general conditions, which can not be solved by an amicable conciliation, the choice of the competent court will be made in accordance with the law.
1 ° ORDER OF REPAIR
On receipt of a vehicle, a repair order is drawn up on the back of which these general conditions must be communicated to the customer and obtain his written approval. The client must clearly specify the nature of the work he wishes to have done and whether he wants an estimate of costs or the direct establishment of an estimate (see Chapter 3). A contradictory examination of the condition of the vehicle must be made and signed by both parties. MYAZ PIÈCESAUTO is only responsible for accessories and devices attached to the vehicle. It is the customer's responsibility to leave no article or clothing in the passenger compartment or the boot.
2 ° ESTIMATE / QUOTE
It may be established, at the request of the customer and prior to taking a vehicle or an organ to be repaired, an estimate of the nature and amount of repairs to be made. This rough estimate, provided free of charge and without dismantling, is only indicative and in no way constitutes a contractual offer. The estimate, requiring removal / installation and dismantling operations, is established following the customer's request for the repair order. He contracts the repairer in a contractual manner on the details of the repairs to be made specifying the details of the parts and labor and their respective costing.
3 ° WORKS
The work is undertaken according to the wishes expressed by the customer on the repair order or quotation signed by the customer who also acknowledged having read the terms and conditions. On this occasion the customer must specify whether he wishes to obtain the return of the replaced parts. This provision applies only to repairs and not to products in exchange or repaired under warranty. If, during the works, it appears necessary to carry out additional operations to those provided on the quote, the repairer must inform the customer, and obtain his written agreement on an amendment to the initial contract before any further repair. The repairer is released from any liability if the customer refuses to order such additional work, even if it may affect the safety of the vehicle. The customer will have to sign a release of responsibility for the benefit of the repairer. Failure to obtain this agreement will enable the repairer to take all necessary measures to safeguard his interests.
For order execution equal to or greater than 1000 € or special orders, regardless of the amount, a deposit of 30% will be due upon confirmation of the order.
Before any intervention, the technician will check the compatibility of the new parts to put on the vehicle, if it turns out that the parts do not match, and that they are provided by the customer, the latter will be paid a package of 80 € corresponding to the trip. A refund of 20 € will be made during the intervention in connection with the replacement of the compliant part.
4 ° TIME
The lead times are only indicative, especially subject to availability of spare parts and their non-compliance can give rise to compensation or penalties. MYAZ PIÈCESAUTO will thus be free from any obligation in the event of a force majeure event beyond its control occurring in the company, as well as from any event occurring at its subcontractors supplying spare parts, raw materials and logistics on supplies and sales.
In the context where the customer's vehicle is deposited at the Atelier d'Ozoir-la-Férrière, that the customer does not respond favorably to the quote, the customer will pay the diagnostic fee "Package 69.00 € TTC" and at parking / security costs from 72H after sending the estimate up to 10.00 € / day.
5 ° AREA OF INTERVENTION
AM AUTO alone can determine whether the proposed intervention zone is satisfactory or not. In any case, any intervention on the public road is strictly prohibited, it is imperative to have an area dedicated to the intervention to delimit a security perimeter. In the case of an outdoor intervention refer to the article on climatic conditions. For an ideal quality of intervention, an area in a covered garage or an outdoor area to park the workshop vehicle next to the customer's vehicle is preferable. Only our technician intervening on your vehicle will be able to determine if the zone of intervention is acceptable or not.
Weather conditions
In the case of an outside intervention, extreme weather conditions, such as low temperatures, wind or rain, may force us to stop the intervention, in which case a new date will be established with the center. Only the operating technician will be able to determine if the climatic conditions are acceptable or not.
6 ° PAYMENT / RESERVATION OF PROPERTY
Unless previously agreed, the benefits are payable in cash, net of any discount, at the point of sale of the product or complete vehicle. The prices of trade items, spare parts and hourly rates of various services, are those in effect at the time of signing the contract, the company reserves the right to change the selling price at any time and without notice.
In accordance with the law n ° 92 1142 of December 31, 1992, any amount unpaid on the date of payment appearing on the invoice will carry interest of right without preliminary formality. The interest rate will be one and a half times the legal rate in effect on the day the invoice is due. In case of delivery to litigation the amounts due will automatically be increased by 15%, which the customer is obliged to pay under the penalty clause. This amount can not be less than 20 €.
The seller retains ownership of the goods until full payment. The risks are the responsibility of the buyer. No cover under the guarantee can be made on a service that has not been fully paid. Down payments may be retained to cover potential losses on resale.
7 ° PENALTIES OF DELAY
In the event of late payment and payment of amounts owed by the Customer beyond the fixed period, and after the date of payment appearing on the invoice sent to him, late penalties calculated at the rate of legal interest on the basis of the amount inclusive of the price of the services on the invoice, will automatically and automatically acquired the Service Provider, without formalities or any prior formal notice and will result in the immediate payment of all amounts due to the Service Provider by the Customer, without prejudice to any other action that the Service Provider would be entitled to bring, as such, against the Customer.
In the event of non-compliance with the payment conditions listed above, the Service Provider also reserves the right to suspend or cancel the provision of services ordered by the Customer and / or to suspend the performance of its obligations and / or to reduce or cancel any discounts granted to the latter.
8 ° WARRANTY
The guarantee and the responsibility of our company are limited to our direct customers of recipients of our invoices.
MYAZ PIÈCESAUTO products are covered by the legal warranty of hidden defects provided for by articles 1641 and following of the Civil Code. In addition the customer benefits from a contractual guarantee of 1 month without limitation of mileage, as from the date of invoice, known as guarantee of the repair and the spare part. In the case of a repair, the warranty only applies to the parts named on the invoice of the associated service. Replaced parts under the warranty automatically become the property of MYAZ PIÈCESAUTO and the customer can not demand detailed report of our intervention. The customer must, in all cases of warranty claim, provide proof of purchase by producing a copy of our original sales invoice. Interventions made under this warranty do not have the effect of prolonging it unless otherwise provided by law.
IN THE EVENT OF ANY MALFUNCTIONS ASSOCIATED WITH AN INTERVENTION COVERED BY THE MYAZ PIÈCESAUTO GUARANTEE, THE CUSTOMER (IMPERATIVELY PROVIDED WITH THE PURCHASING RATIONALE) SHOULD IMMEDIATELY BE IN CONNECTION WITH OUR TECHNICAL ASSISTANCE TO DETERMINE THE PROBLEM EXACTLY.
IN CASES WHERE THE COMPLAINT HAS NO RELATION TO THE INTERVENTION CARRIED OUT, A € 300 PACKAGE WILL BE APPLIED. (Travel expenses and time spent)
We undertake to take care, during the warranty period, for vehicle analysis exclusively in Ile de France, the only geographical area to which this warranty, as all our general conditions apply. In the case of a direct sale outside the metropolitan territory, or a subsequent export to the sale, it is up to the customer to repatriate the product or the complete vehicle in Ile de France from which we will take care of it.
The guarantee will be granted if the product is recognized as defective by our after-sales service, after analysis. In this case, we are free:
- to repair the defective product
- exchange it with equivalent equipment
In these two cases our commitment is limited to its replacement (individual part or refurbished body) or its restoration in good working order and its forwarding to the customer as soon as possible, without the customer being able to claim the free provision of a new product or standard exchange of the manufacturer network. Our warranty does not cover any costs incurred by third parties: troubleshooting, removal / resale, rental fees, operating or usage loss, depreciation of the vehicle, etc. for which the user of the vehicle, in particular professional, must have taken out individual insurance.

In the case of sale of insulated spare parts, the guarantee is limited to the only replacement or refund of the parts recognized as defective after analysis by MYAZ PIÈCESAUTO.
The guarantee will not be granted
- if the product has not been installed by MYAZ PIÈCESAUTO in accordance with the rules of the art and specific instructions of the manufacturer.
We reserve the right to require the presentation of the bill of assembly of our product on the vehicle.
- if, during its installation, the product has been connected to defective mechanical or electronic devices that caused the disorders or damage noted.
- if it has not been maintained with the periodicity and ingredients provided by the manufacturer (we reserve the right to demand the presentation of maintenance invoices)
- it is manifest that the damage suffered is the result of any misuse of the product or that the product has been diverted from its original use or application by an adaptation not approved by the manufacturer.
- if the product has undergone an intervention after our delivery not expressly authorized by MYAZ PIÈCESAUTO.
- if the product has been used in any type of competition or car raid.
9 ° CLAIMS
In the absence of reservations or claims expressly issued by the Customer upon receipt of services, these will be deemed to comply with the order, in quantity and quality.
The Customer will have a period of 7 days from the provision of the services and the receipt thereof to issue, in writing, such reservations or claims, with all supporting documents, to the Provider.
No claim can be validly accepted in case of non compliance with these formalities and deadlines by the Customer.
The Service Provider shall rectify as soon as possible and at its expense, the services provided, the lack of which has been duly proven by the Customer.
10 ° LITIGATION
All disputes to which this contract could give rise, concerning its validity, its interpretation, its execution, its termination, their consequences and their consequences will be submitted to the competent courts under common law conditions.
11 ° INFORMATICS AND FREEDOMS
The personal information requested from the client for the proper execution of the contract of sale may be processed by MYAZ PIÈCESAUTO for the purpose of operations such as statistics, satisfaction surveys or commercial prospecting. This information is exclusively intended for MYAZ PIÈCESAUTO and in application of the law n ° 78-17 of January 6th, 1978 relating to data processing, the files and the liberties, the customer will be able to exercise his rights of access and rectification with our Commercial Service.
12 ° LANGUAGE OF THE CONTRACT - APPLICABLE LAW
By express agreement between the parties, this contract is governed by and subject to French law.
13 ° ACCEPTANCE OF THE CLIENT
These General Conditions of Sale are expressly approved and accepted by the Customer, who declares and acknowledges having perfect knowledge of them, and therefore waives any contradictory document and, in particular, his own general conditions of purchase. , which will be unenforceable against the Service Provider, even if it has become aware of it.
14 ° LEGAL INFORMATION
